北京盈科（合肥）律师事务所接受 汽车工具有限公司的委托，指派本律师就贵司专利侵权的相关事宜，郑重致函如下：

Beijing  Yingke (Hefei) Law Firm accepted the commission of Anhui Guangde Zhongding Automobile Tools Co., Ltd. and assigned me as their lawyer on sending a letter in related to a patent infringement of your company, details as follows:

一、根据   工具有限公司的陈述及提供的相关材料，并经本律师核查，确认如下事实：

Based on the statements and some relevant materials provided by Anhui Guangde Zhongding Automobile Tools Co., Ltd., the following facts can be confirmed:

1、安徽省   汽车工具有限公司享有如下三项专利权，具体情况如下：

Anhui Guangde Zhongding Automobile Tools Co., Ltd. enjoys the following three patents, details as follows:

2、贵司目前正在采购的TORIN公司生产的千斤顶产品系侵犯安徽省**汽车工具有限公司以上3项专利的侵权产品。

The floor jack which your company is purchasing from TORIN are the infringing products which is in violation of the above three patents.

二、基于以上事实，本律师认为：

Based on the above facts, I thought:

根据《专利法》第11条第1款规定（即：发明和实用新型专利权被授予后，除本法另有规定的以外，任何单位或者个人未经专利权人许可，都不得实施其专利，即不得为生产经营目的制造、使用、许诺销售、销售、进口其专利产品，或者使用其专利方法以及使用、许诺销售、销售、进口依照该专利方法直接获得的产品。），贵司向TORIN公司购买侵权产品的行为属于侵犯安徽省**汽车工具有限公司专利权的侵权行为。

According to article 11 (1) in the Patent Law of the People's Republic of China (that is: After the invention or utility model patent right is granted, except as otherwise provided by this law, no unit or individual without the permission of the patentee shall not exploit the patent, that is shall not manufacture, use, offering for sale, sell or import the patent product which are with the purposes of business,  or use the patent method and use, offering for sale, sell, import the product which is made by using the patent method.), the act that your company purchase infringing products(floor jack) from TORIN is violating the legal right of Anhui Guangde Zhongding Automobile Tools Co., Ltd. .

三、为此，本律师获授权郑重声明如下：

Therefore, as their lawyer, I am authorized solemnly to declare as follows:

1、请贵司在收到本函件后三个工作日内立即停止向TORIN公司购买侵权产品，并与TORIN公司协商解决事宜。

Please immediately stop purchasing the infringing products from TORIN within three working days after the receipt of this letter and solve this matter with TORIN through negotiation.

2、如贵司继续侵权行为，本律师将根据    汽车工具有限公司的委托，依《专利法》第六十条的规定，向管理专利工作的部门投诉或直接向人民法院起诉，届时，贵司将会承担诸如商誉损失及侵权造成的损害赔偿和因处理专利侵权事宜所支出的其他费用等一切不利法律之后果。

If your company continues further infringement, with the commission of Anhui Guangde Zhongding Automobile Tools Co., Ltd., I will complain to the patent administrative authority for patent affairs or directly bring a suit in a people's court in accordance with the provisions of article 60 of the Patent Law. At that time, your company will bear adverse legal consequences such as the compensation for damages caused by goodwill losses and infringement and other fees due to handling matters relating to the patent infringement.

以上意见请贵司慎重斟酌，我方抱竭诚之意，愿与贵司友好解决此事，故特发此函。
